Proses demokrasi yang dimaksud bisa melalui pemilihan dengan menggunakan suara masyarakat secara langsung atau pemilihan tak langsung lewat parlemen. Hadirnya UU Nomor 1 Tahun 2015, pelaksanaan Pilkada mulai dilaksanakan di semua daerah secara bersamaan. Pada Pilkada 2024 ini diikuti oleh semua provinsi dan kabupaten atau kota yang ada di Indonesia. Maka dari itu, ada sebagian provinsi dan kabupaten atau kota yang dipimpin oleh Penjabat Kepala Daerah sejak tahun 2022 karena masa jabatan kepala daerah sudah habis sebelum pelaksanaan Pilkada 2024. Pengangkatan Penjabat Kepala Daerah menimbulkan kontroversi karena banyaknya unsur politik dalam pemilihan Penjabatnya sehingga sebagian orang menilai hadirnya Penjabat Kepala Daerah menyalahi konsep demokrasi. Artikel ini memakai metode penelitian hukum normatif. Mekanisme penunjukkan Penjabat Sementara Kepala Daerah saat ini ada didalam Pasal 201 ayat (9), (10), dan (11) UU Nomor 10 Tahun 2016 dan Permendagri Nomor 1 Tahun 2018. Berdasarkan temuan penelusuran, Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Wilayah mengatur substansi strategi pengusiran kepala wilayah. Dengan cara ini, kepala wilayah yang tidak menjabat dapat diberhentikan jika mereka terbukti menyalahgunakan kendali undang-undang. Dengan demikian, ada dua macam pembelaan, yakni berdasarkan watak atau kepandaian kepala wilayah, dan berdasarkan pertimbangan moral, dalam hal kepala wilayah diberhentikan karena melakukan pelanggaran otoritatif atau pidana (UU Kewenangan Negara). ). Indonesia menganut sistem pemerintahan presidensial dengan pemilihan proporsional terbuka, namun dengan esensi penerapan presidensial muncul sebuah permasalahan dengan adanya konsep multi partai, artinya partai satu dan partai lain saling berinteraksi untuk mendukung pencalonan presiden. Perpaduan sistem presidensial dan sistem multi partai dapat menghasilkan persoalan yang kompleks, terutama ketika disertai dengan tingkat fragmentasi dan dinamika politik yang cukup tinggi. Sistem presidensial dan multi partai bukan hanya kombinasi sulit, tetapi juga dapat membuka kemungkinan terjadinya kebuntuan (<em>deadlock</em>) dalam hubungan eksekutif- legislatif, yang pada akhirnya dapat mengakibatkan instabilitas dalam sistem demokrasi presidensial.. Penelitian ini menggunakan metode penelitian yuridis-normatif dengan`mengkaji berdasarkan peraturan perundang-undangan terkait yang dielaborasi dengan studi kepustakaan. The state<br>constitution must be able to adapt to rapid socio-political changes<br>in order to remain relevant to the needs of society. This research<br>aims to analyze the challenges and solutions in the process of<br>constitutional change in Indonesia today. The method used in this<br>research is a normative approach with literature study, which<br>examines various primary and secondary legal sources related to<br>constitutional amendments and changes in Indonesia. The findings<br>show that the main challenges in changing the constitution in<br>Indonesia include political tensions, resistance from conservative<br>groups, and amendment procedures that are quite complicated and<br>require broad consensus. In addition, the rapid development of<br>information technology and continuously changing social<br>dynamics are often not reflected in existing constitutional<br>provisions. The discussion in this research identifies several<br>solutions, such as the need for more flexible reformulation of<br>amendment procedures, strengthening public participation in the<br>change process, and the application of technology to accelerate the<br>adaptation of the constitution to changing times. Al-Maidah: 33-34 2025-04-30T11:13:37+07:00Salma Dinanadinasalma@gmail.com<p>On August 2, 2009, in Darmakradenan Village, Ajibarang District, Banyumas, Central Java, Grandma Minah who was farming on her land which was also used as a cocoa plantation by PT RSA, took some cocoa fruits without permission. Grandma Minah's actions were later discovered by a plantation foreman who was on patrol. This research method uses a normative legal research method using the Case Approach which examines cases that occur in society and then examines them from the perspective of laws and regulations. The results of the study showed that there were weaknesses in the regulation of criminal penalties for minor crimes, as well as handling criminal acts using the conventional justice system or restorative justice in Grandma Minah's case and there was a view of Munir's Interpretation of QS Surat Al-Maidah verses 33 & 34 regarding criminal cases that Allah SWT allows them to turn it around before being arrested. Even though if this embryo cloning process occurs, it can disrupt the existing legal order in Indonesia, such as the Marriage Law, Inheritance Law and others. The research method used is a qualitative research method that produces descriptive data in the form of writing from the observed research object. The type of research in this study is using library research, namely through a method that collects data by understanding and studying theories from various literature related to the object of research. The results show that cloning is a method of procreation without going through the asexual process, so it can be said to have similarities with attempts to conceive outside of natural means. This is the same as stated in Government Regulation No. 61 of 2014 concerning reproductive health contained in Article 40 verse (1) that assisted reproduction or pregnancy outside of natural means can only be carried out in married couples who are bound by a legal marriage and experience infertility to obtain offspring, Then verse (2) explains that it is carried out by using the results of fertilization of sperm and ovum originating from the husband and wife concerned and implanted in the womb of the wife from which the ovum originated.
